A copy of this Lease is enclosed.

The lessees in this case were two
Chinese, Chau Kwai-Chi and Lai Hok-Tsun, both traders of
Victoria in this Colony.
They brought an action of damages for
trespass and conversion against a Chinese fisherman who, they
alleged, had infringed their rights under the Lease.

This action was heard, by direction of
the Chief Justice, before the Full Court which delivered
Judgment on the 29th, June, 1900. I enclose copies of those
Judgments from which you will gather that there was a diffe-
rence of opinion between the Chief Justice and the Acting
Puisne Judge.

Under the provisions of Section 19 of
Ordinance No. 12 of 1873 the Judgment of the Chief Justice,
which was adverse to the Plaintiffs, became the Judgment of
the Full Court.
That Judgment practically decided that
the Crown had not the right to grant a Lease of the nature of
the Lease of Lantao Marine Lot No. 2.

When this Judgment had been delivered,
I took the advice of the Attorney-General and now transit a
copy of the Minute which he wrote dated 13th. July, 1900.
As the decision might have a far-reaching,
effect upon the rights of the Crown, every endeavour was
made by the promise of financial aid and otherwise, to induce
the unsuccessful plaintiffs to apply to the Full Court for
